The Dangers of Social Media in Family Law Cases

Social media is a major part of how people stay connected for their business, friends and family. Access to social media can have some detrimental effects to a person’s family law case, or any other case for that matter. In this video, I interview family law attorney Jeremy Swanson of Swanson and O’Dell to explore the topic of the dangers of social media to a family law case.

Some key points to remember are:

  • Social media is public even when you set you privacy settings to friend’s only
  • If you have to think twice about posting something, error on the side of caution and don’t post it
  • Innocent posts can be taken out of context and used against you in your case
  • Don’t use social media to complain or vent about your case, talk to friends and family directly instead
  • If you have made some embarrassing posts about your case, you need to be aware that removing those posts after litigation can be considered destruction of evidence that can be used against you.

The key thing is to use social media carefully and responsibly so that you do not damage your reputation and your case. If you wonder whether it is a good idea to post something, don’t do it.
